Fairmont, MN (KICD)– A Fairmont police officer has been cleared of any wrong doing following an investigation into an officer involved shooting we first brought you in January.
The Martin County Attorney’s Office has reviewed the investigative reports put together by the Minnesota Bureau of Criminal Apprehension (BCA) from the January 20th shooting death of Nicholas Moore.
The BCA report states the Fairmont Police Department was called to the apartment building after receiving a 911 call from a female saying she was being threatened. Upon arriving at the scene, an officer reported hearing a person crying and a female yelling for help at which time the officer forced entry and immediately observed Moore coming at him with a knife in each hand.
While being ordered to drop the knives, Moore then exited the apartment and ran toward Officer Craig Fowler who attempted to retreat, but fearing for his safety drew his weapon and fired two shots, both of which struck Moore.
The officer accounts were backed up by an resident in a nearby apartment who told investigators she hear one officer ordering Moore to drop the knives before hearing the two shots.
The knives were recovered as evidence and with Moore’s fingerprints being found on one and his DNA on the other.
There was no physical evidence to contradict the accounts of the witnesses which led to the Martin County Attorney’s Office deciding not to file charges on Officer Fowler.
